Is it legal to have a salary employee work 6 hours on saturday and not get paid anytime extra?
legal
**DoGetLoud** asked:

My job had us work on the Saturday after the Ike hurricane for 6 hours. On a regular basis if we work on a saturday they would pay us overtime. Well come to find out the company decided that this was a “special” situation and they are NOT going to pay any overtime or anything extra. Is this legal Im in Texas. Please help!

Well a salary employee gets paid the same thing every pay period regardless of time worked. If you were hourly, then that would be different.

Yes. It’s one of the “problems” with being salaried. Now, it might not be legal for your position to be SALARIED (also known as exempt).

You would have to contact the Dept of Labor that will answer specifically to labor questions regarding Hurricane Ike and Gustov. The
toll-free helpline at 866-4-USA-DOL (487-2365). Operators also will be able to refer questions about wage-related, paycheck and safety issues to staff who can help directly or point callers in the right direction for more information.

I thought salary meant you could work as much as they wanted you to and not pay you extra. I go from hourly to salary next month…it will probably not be very fun. Sorry for you.

If you are a salaried employee then they are not required to give you extra compensation.

If you are an hourly employee then, under normal circumstances, they would need to pay you for your time but maybe because your state was just hit by a hurricane your time was considered voluntary…
