What are the legal implications of delivery drivers for a restaurant/pizzeria?

Our business is considering adding the delivery of food/pizza to our customers as an option. However, we need to know what kind of legal implications are involved in this. Obviously we will need some kind of insurance to cover our drivers. However, do we also need to insure against anything else, such as lawsuits, fraudulent claims, or other things I have not thought of?

    hire them under a sub-contractor basis and you will not have any of these issues.

    I believe Freddo Frogs answer is basically correct. But I would have a conversation with your insurance carrier and a lawyer to be sure. The grey area comes in if you require them to display a restaurant sign on their vehicle. I’m not sure you would get the insulation from lawsuits a typical sub contractor arrangement would provide. But, even with sub contractors, there are circumstances where you would be open to lawsuits.
    Good luck with adding the delivery service. It will probably have a few hiccups in the beginning, but it should increase your business in the long term. Give people time to realize the service is available and start to use it. I used to work as a pizza driver when I was in college. Our driving staff would outsell the dining room every Friday and Saturday and EVERY Super Bowl Sunday, so the potential is there for a great opportunity.
