What legal choices do I have against a child that is bullying and harrasing my daughter?

My daughter is in high school and has been bullied by the same girl for the past two years. It is a Catholic school and the principal is aware of the situation. I am now ready to take legal action against this child. Any serious replys are welcome.

First speak to the other girls parents. I had a similar problem in school , my parents spoke to her parents and it ended. If that doesn’t work you should call the police depending on the state harassment may be illegal.
sue the school they have more money than the girl and her family. they are causing a hostile envirnoment for your daughter. being that they know about the situation, they could be held neglegent for emotion destress and you could be awarded damages. even if she is still gettin bullied she can cry all the way to the bank after you win a settlement against the school
Legal action is taking a step in the right direction. Also consider this. When President Bush implemented the “No child left behind act” it also included wording to facilitate the very problem that you are having. It states, (and I am paraphrasing), that a student is protected, by law, from the time he/she leaves home until he returns.
This bully is, according to this Act, interfering with your childs education and she(and her parents) can be prosecuted.
I have used this Act personally with my own child and it works. It is best that you, as a parent, familiarize yourself with the rights that your child has as it pertains to her education. Every child in this country has a right to have an education, free of bullying.

You’ve already discussed this with the principal. If this is occurring on school property, the principal is responsible for taking the appropriate steps. You could try talking to the parents. Two years is a long time for a situation to be unresolved. I don;t know your definition of the word bullied, but if it constitutes harassment, or assault, your last option would be to call the Police.
Lil Mami is right. It is the school’s responsibility to provide a stable, distraction free learning environment. Go to the school and threaten litigation and the bullying will stop…at least at the school.
I would reccommend talking with the school to advise them of the problem. While schools are responsible for providing a safe environment, if they aren’t informed of a problem then they can’t solve a problem they don’t know about. If the harassment and bullying continues, you could file a police report. From there, you could take the report and talk to a judge in juvenile or family court and file a petition through the juvenile justice system. This would be similar to filing a complaint for a warrant against an adult. The juvenile justice system is very different and more complicated than the adult system, but it can work. But first I suggest talking to the school and the other child’s parents, and use the juvenile justice system as a last resort.
Get a restraining order! If that doesn’t work, beat the crap out of her!

File a law suit if she has done nothing PHYSICAL, if she has physically harmed your child have her call 911 and she could be arrested for assault.
Tell the school that you have the lawyer ready to file a lawsuit. If they don’t want to be a part of it, they better offer you a better solution.

Do so that will probably be the only way to abate the situation in the long run…
